La demande de renouvellement doit \u00eatre d\u00e9pos\u00e9e aupr\u00e8s de la commune au plus tard un mois avant l'expiration de la p\u00e9riode de cinq ans, et la commune proc\u00e9dera \u00e0 une nouvelle \u00e9valuation de la demande.<\/p><h4><strong>Un bien immobilier ne peut \u00eatre lou\u00e9 \u00e0 des touristes que dans son int\u00e9gralit\u00e9.<\/strong><\/h4><p>La location \u00e0 la chambre n'est pas autoris\u00e9e.<\/p><h4><strong>R\u00e9f\u00e9rence cadastrale figurant sur les documents officiels et les contrats<\/strong><\/h4><p>Il est important d'indiquer la r\u00e9f\u00e9rence cadastrale sur les documents officiels et les contrats.<\/p><h4><strong>En cas de modification, une nouvelle demande doit \u00eatre d\u00e9pos\u00e9e.<\/strong><\/h4><p>En cas de r\u00e9novation, de construction neuve, de vente, de donation ou d'h\u00e9ritage, une nouvelle demande d'autorisation de location touristique doit \u00eatre d\u00e9pos\u00e9e pour le bien immobilier concern\u00e9.<\/p><h4><strong>Les locations combin\u00e9es ne sont pas autoris\u00e9es<\/strong><\/h4><p>Si vous poss\u00e9dez un bien immobilier que vous louez \u00e0 des touristes, vous n'\u00eates pas autoris\u00e9 \u00e0 le louer pour d'autres types de location, tels que les locations \u00e0 moyen ou long terme.<\/p><h4><strong>\u00c0 louer d'ici deux mois<\/strong><\/h4><p>Une fois votre licence de location touristique obtenue, vous devez d\u00e9marrer votre activit\u00e9 de location dans un d\u00e9lai de deux mois, faute de quoi la licence expirera.<\/p><h5><strong>Quelles sont les obligations l\u00e9gales applicables \u00e0 un logement destin\u00e9 \u00e0 la location touristique ?<\/strong><\/h5><p>Outre les recommandations ci-dessus, le logement lui-m\u00eame doit \u00e9galement r\u00e9pondre \u00e0 certaines caract\u00e9ristiques de base.<\/p><h5><strong>Un plan d'\u00e9vacuation devrait \u00eatre affich\u00e9 \u00e0 l'int\u00e9rieur de la porte d'entr\u00e9e.<\/strong><\/h5><ul><li><strong>Un ascenseur doit \u00eatre pr\u00e9vu dans tout immeuble comptant au moins quatre \u00e9tages.<\/strong><\/li><li><strong>Prises \u00e9lectriques dans toutes les pi\u00e8ces.<\/strong><\/li><li><strong>Alimentation en eau chaude disponible.<\/strong><\/li><li><strong>Une liste des num\u00e9ros de t\u00e9l\u00e9phone d'urgence et importants, affich\u00e9e \u00e0 un endroit bien visible.<\/strong><\/li><li><strong>Climatisation (au moins dans le salon\/salle \u00e0 manger ou la cuisine).<\/strong><\/li><li><strong>Chauffage (au moins dans le salon\/salle \u00e0 manger ou la cuisine).<\/strong><\/li><li><strong>Connexion Internet, sauf si le logement se trouve dans une zone non couverte.<\/strong><\/li><li><strong>Trousse de premiers secours.<\/strong><\/li><li><strong>Informations d\u00e9taill\u00e9es sur le centre m\u00e9dical le plus proche.<\/strong><\/li><li><strong>Service de remise des cl\u00e9s. La remise des cl\u00e9s par le biais de casiers situ\u00e9s sur la voie publique est interdite.<\/strong><\/li><li><strong>Il est indispensable de faire appel \u00e0 un service de nettoyage.<\/strong><\/li><li><strong>Le linge de lit doit \u00eatre chang\u00e9 r\u00e9guli\u00e8rement.<\/strong><\/li><li><strong>Les r\u00e9parations et l'entretien doivent \u00eatre effectu\u00e9s r\u00e9guli\u00e8rement.<\/strong><\/li><\/ul><h4><strong>DERNI\u00c8RES NOUVELLES :<\/strong><\/h4><p><strong>Depuis 2025, le propri\u00e9taire doit demander \u00e0 la copropri\u00e9t\u00e9 un certificat attestant que les locations touristiques sont autoris\u00e9es par celle-ci.<\/strong><\/p><p><strong>Sans ce permis, le formulaire de demande sera rejet\u00e9 par la Communaut\u00e9 autonome de Valence.\u00a0 <\/strong><\/p><h4><strong>Quelle devrait \u00eatre la dotation minimale d'un logement de location touristique ?<\/strong><\/h4><p>Le logement doit \u00eatre \u00e9quip\u00e9 de meubles, de couverts, d'ustensiles de cuisine et de linge de maison. Toutes les chambres doivent disposer d'un placard, qu'il soit situ\u00e9 \u00e0 l'int\u00e9rieur ou \u00e0 l'ext\u00e9rieur de la pi\u00e8ce. Le logement doit disposer d'une connexion Internet et d'un t\u00e9l\u00e9viseur, sauf dans les zones non couvertes par le r\u00e9seau.<\/p><p>La cuisine doit comporter au moins :<\/p><ul><li><strong>R\u00e9frig\u00e9rateur<\/strong><\/li><li><strong>Fer<\/strong><\/li><li><strong>Four\/micro-ondes<\/strong><\/li><li><strong>Extracteur<\/strong><\/li><li><strong>Plaque de cuisson \u00e9lectrique \u00e0 2 feux minimum (logements pouvant accueillir jusqu'\u00e0 4 personnes*).<\/strong><\/li><\/ul><p>*Pour les logements pouvant accueillir plus de 5 personnes, la cuisine doit \u00eatre \u00e9quip\u00e9e au minimum d'une cuisini\u00e8re \u00e9lectrique \u00e0 3 feux.<\/p><h4><strong>Amendes en cas de non-respect<\/strong><\/h4><p>La nouvelle loi pr\u00e9voit des amendes en cas de non-respect de ses dispositions, allant de\u00a0<strong>\u20ac10,000<\/strong>\u00a0\u00e0\u00a0<strong>\u20ac600,000<\/strong>, en fonction de la gravit\u00e9 de l'infraction. Des amendes peuvent \u00eatre inflig\u00e9es en cas de non-mention correcte de l'emplacement exact et des informations d'enregistrement du bien immobilier dans les annonces, de non-d\u00e9claration des transferts de propri\u00e9t\u00e9 ou de mise en location ill\u00e9gale de chambres \u00e0 des touristes.<\/p><h4><strong>Licences de location touristique existantes<\/strong><\/h4><p>La nouvelle loi est entr\u00e9e en vigueur le 2 ao\u00fbt 2024. Il existe trois types de dispositions transitoires concernant les autorisations de location existantes :<\/p><ul><li><strong>Pour les \u00e9tablissements ayant obtenu leur licence avant le 1er juillet 2018<\/strong>: Ceux-ci pourraient conserver leur licence sans modification.<\/li><li><strong>Pour les \u00e9tablissements agr\u00e9\u00e9s entre le 7 juillet 2018 et l'entr\u00e9e en vigueur de la nouvelle loi<\/strong>: Ces entit\u00e9s pourront conserver leur agr\u00e9ment, mais devront se conformer \u00e0 de nouvelles exigences dans un d\u00e9lai de cinq ans et renouveler leur agr\u00e9ment avant 2030.<\/li><li><strong>Pour les logements neufs construits apr\u00e8s l'entr\u00e9e en vigueur de la nouvelle loi<\/strong>: Ceux-ci doivent se conformer imm\u00e9diatement aux nouvelles r\u00e8gles et renouveler leur agr\u00e9ment ainsi que les autres formalit\u00e9s administratives tous les cinq ans.<\/li><\/ul><h4><strong>Pourquoi cette nouvelle loi sur la location touristique ?<\/strong><\/h4><p>La nouvelle loi vise \u00e0\u00a0<strong>tourisme \u00e9quilibr\u00e9<\/strong>\u00a0en termes de qualit\u00e9 de vie pour\u00a0<strong>les habitants du quartier<\/strong>. Les chiffres du tourisme ont atteint des niveaux records en 2023 et 2024. Avec cette loi, les autorit\u00e9s souhaitent s'assurer que les locations touristiques s'effectuent de mani\u00e8re organis\u00e9e, afin de pr\u00e9server un \u00e9quilibre avec les autres types d'h\u00e9bergements touristiques. Cela permet de garantir une offre durable et de qualit\u00e9.<\/p><p>De plus, la loi contribue \u00e0 lutter contre la concurrence d\u00e9loyale exerc\u00e9e par les personnes qui louent ill\u00e9galement leur logement. Ces locations ill\u00e9gales nuisent au secteur touristique r\u00e9glement\u00e9 et \u00e9chappent au contr\u00f4le des pouvoirs publics. Elles favorisent \u00e9galement la circulation d'argent noir et peuvent \u00eatre source de conflits avec les riverains. La loi prot\u00e8ge le secteur touristique respectueux de la r\u00e9glementation, luttant ainsi contre la concurrence d\u00e9loyale.<\/p><h4><strong>Location pour 11 jours ou plus<\/strong><\/h4><p>Les directives ci-dessus rel\u00e8vent de la nouvelle loi adopt\u00e9e pour l'ensemble de la Communaut\u00e9 valencienne. Elles concernent ici les locations touristiques d'une dur\u00e9e inf\u00e9rieure ou \u00e9gale \u00e0 10 jours. Cela ouvre \u00e9videmment la voie \u00e0\u00a0<strong>opportunit\u00e9s<\/strong>\u00a0pour les locations \u00e0 moyen terme, dont la dur\u00e9e est d\u00e9sormais comprise entre\u00a0<strong>De 11 jours \u00e0 11 mois<\/strong>. Aucun permis sp\u00e9cifique n'est n\u00e9cessaire pour cela. Il en va bien s\u00fbr de m\u00eame pour les locations \u00e0 long terme \u00e0 partir de 11 mois.
